Each state legal requirement varies but you typically need to have a red flag or similar visual aid for something that overhangs (more than 3-4ft) the back of your vehicle, especially something like a kayak.
In my mind, even if there isn't a legal requirement, anything I can do to help someone see a kayak when driving behind me is a good thing because looking at at kayak end on, it doesn't cut much of a profile.
I keep a few of these on hand for the shop vehicle and make use of them fairly frequently.
